Roeland, re-read my text more carefully.  I phrased it precisely and though 
I am not a lawyer am pretty sure it is correct.

There is no magic to "market forces".  People defraud customers all the time.

Selling them an alternative root, claiming that it will work fine, is 
fraud.  Particularly after the seller is aware of the IAB paper.

ps.  Though it is great fun to debate this issue, we have already consumed
