[comments-wgb] Comments on "Sunrise" proposal



Some questions:

What constitutes a famous trademark?  

What if several entities in different industries or countries meet the
criteria for the same trademark name?

Huge American corpration Acme(tm) industries makes several products for retail
sale.
Acme(tm) gmbh is a large chain of deparment stores in Germany.
Who has the right to register acme.shop?  Who would have the right to
acme.shop if they battled it out in court?

How does this improve upon the current domain dispute policy?

The reason NSI doesn't take care of domain disputes is because this belongs in
the realm of the courts.  NSI, or ICANN have no more right than I to determine 
which Acme(tm) can register acme.shop.

The more I think about this proposal, the more ludicrous it seems.  It's a
textbook case of 'Those who don't learn from the past are condemned to repeat
it.'
