Roger-

The constituencies do not automatically lose their voting rights. Our
procedure calls for notices, with various language, at 30, 60, 90, 120
days, with suspension of rights at 180 days.

Also, I do not see how this policy could be applied retroactively. The
written notices would have needed to go out to the constituencies,
starting the day the NC passed the resolution.

Who has a record of notices sent to date?

Further to my attached note of July 26, I would like to add one item to
the agenda for tomorrow's Budget Committee teleconference:  the status
and outlook for our current fund-raising campaign [ i.e. voluntary
donations ] The campaign, which is aimed at raising $120K in donations [
$60K excluding the VeriSign matching donations ] has gotten off to a
slow start.  We need to spend some time discussing how to jump-start it.


 As you know, these funds are intended to be used to cover the costs of
professional support for the Names Council and if we fail to raise them,
the Council performance will continue to suffer.

Also, with regard to the agenda item on delinquent payments by DNSO
Constituencies, we need to determine the intent of the Council's earlier
decision to apply sanctions on Constituencies that are late in paying
their DNSO dues.  Specifically, we need to determine whether the intent
was to apply the penalties to late-paying Constituencies regardless of
the year in which their delinquency arises, or whether the intent of the
Council's resolution was to apply the sanctions only to Constituencies
who are late paying for the 2001 dues.

If we conclude that the Council intended to apply the penalties for
failures to pay pre-2001 dues, then my calculation is that  three
Constituencies (the ccTLD, the Non-Commercial, and the ISP
Constituencies ) have passed the 120 day delinquency date and are
subject to their loss of their voting privileges in the Names Council.  

If we conclude that the Council intended to apply these procedures for
failures to pay 2001 and later dues, then my calculation is that three
Constituencies will lose their voting privileges on August 18 (120 days
after the April 18th date of the DNSO invoice to them):  the Business,
the ccTLD, and the ISP Constituencies.  [ ICANN management did not
invoice the Non-Commercial Constituency on April 19th, and does not seem
to have invoiced them until July of 2001, in which case the clock for
that Constituency would seem to have not started ticking until about
three months later then the others.]

Finally, we need to revisit the DNSO's 2001 budget in light of changed
circumstances:  (1) We have not had professional staff support, and thus
have not incurred the operating  costs of such, since January....nor are
we likely to have professional staff support on board prior to the
fourth quarter of this year.  Thus, we need to budget only one quarter,
not four quarters, of such support; and (2) Considering that we have
agreed to pay AFNIC $5,000 per month commencing in April and that the
Search Subcommittee seems to be moving towards an expense for Web and
Listserv hosting services that will be well in excess of the annual
$30,000 budgeted for this item, we clearly need to revise the amount
budgeted for this item.  By the end of August, we will have committed
$25,000 of the total of $30,000 in the budget for AFNIC expenses alone.
My sense is that we need to increase the budget allocation for this item
from $30,000 in 2001 to $70,000.

Accordingly, I would propose the following changes to the DNSO 2001
budget:

Based on Elizabeth's late request and Vany's support for a postponement,
I am reluctantly postponing the Budget Committee telecon until next
week.  It is important to note, however, that during the summer, we will
never find a time that is convenient for everyone and that  -- much as I
admire Philip - he is not a regular member of the Committee;  he is an
ex-officio member because of his role as Names Council Chair [he could
join as a regular member if he wanted to do so.]

So we'll get back to everyone to find a time that is most convenient for
the most people next week.

In the meantime, here is the proposed agenda and some background
materials for the next meeting.  There are basically two matters that we
must address.

NC PROCEDURES FOR CONSTITUENCIES PAYMENT OF DUES

Regarding the procedures of the Budget Committee, the Committee decided
that its meetings should not be routinely open, but rather should be
open to members of the Committee and any member of the Names Council who
would like to observe.  The Committee reached this conclusion because:
(1)	it often discusses financially sensitive information; (2)
members
felt that the work of the Committee would benefit greatly by an
atmosphere in which innovative ideas could be floated; and most
importantly, (3) all of the Committee's reports to the Council and
actions by the Council are publicly accessible.

Regarding procedures to address the failure of DNSO Constituencies to
pay their assessed dues, the Committee discussed this matter during
three different meetings and in its January meeting agreed to propose to
the Council the following procedures:
>From the date that invoices are mailed/e-mailed to representatives of
Constituencies, if payment is not received by the DNSO or its agent by:
** 30 days, the Constituency is sent a reminder letter and another
invoice
** 60 days, the Constituency is sent a delinquency notice and the
delinquency notice is posted on the DNSO Website
** 90 days, the Constituency is sent a "show cause notice" (in which
they are asked to show cause as to why their voting rights in the Names
Council should not be suspended) and they are charged a 5% late payment
fee to cover the cost to the DNSO of the cost of money.  The 5% penalty
is added to that Constituency's dues for the next (not the current) DNSO
budget year.
** 120 days, the Constituency is sent a "final notice to pay" and
charged an additional 5% late payment fee, which is also due as a added
payment for their next year's DNSO dues
** 180 days, the voting rights, but not the right to participate, of
that Constituency's representatives to the Names Council are suspended
until such time as the DNSO or its agent receives all past due amounts
including the varies late payment fees.
