[council] Final revised report of the Review task force


With regard to the election of the General Assembly Chair, the recommendation 
of the Review Task Force states:  "There does not appear to be a demonstrated 
need to seek a change in the ICANN by-laws at present."  

In view of the fact that the overwhelming majority of the General Assembly 
has voted to establish a bicameral DNSO, there is clearly a need to revisit 
the Bylaws on this point and on many others.   The attempt by the Task Force 
Chair to bury this issue under the rug, and to summarily close the Review 
process when there are still numerous unresolved issues affecting the DNSO 
membership is a grievous dereliction of duty.  This Task Force, as per its 
mandate, has failed to assess whether changes are either beneficial or 
required.  

In the course of the last four months, this Task Force has generated a 
patheticly low amount of comments by its members on the Review list -- less 
than 30.  This stands in contrast to the 1500 comments received within the 
course of only three weeks by the Review Working Group.  This TF cannot claim 
that it has thoroughly reviewed the issues that it was charged to examine.  
Its efforts are as fraudulent as are its conclusions and are not based on the 
community will.

With regard to representation for individuals, this Task Force has again 
shirked its responsibility and has done absolutely nothing to promote the 
establishment of an individuals' constituency.  Its proposed criteria could 
not even be met by existing constituencies, and thus stands at odds with the 
requirement of the Bylaws that "The Corporation and its subordinate entities 
shall operate to the maximum extent feasible in an open and transparent 
manner and consistent with procedures designed to ensure fairness."  If one 
standard does not apply to all, then there is no "fairness".

The recommendation on language translations is singularly disgusting:  "Given 
its highly limited resources and the higher priority of substantive policy 
issues, the DNSO should not spend more time on this, but note the progress 
being made by ICANN staff in this regard and where appropriate to participate 
in any cost-effective solution."  There is no progress being made on this by 
ICANN staff... this is simply the Council passing the buck and refusing to 
take responsibility.  

I was able to send a letter to VNNIC asking for assistance in translating 
ICANN documents into Vietnamese and French.  They immediately replied with a 
strong offer of assistance.  This Council could do the job of getting 
necessary translations, but instead it seems to have little regard for the 
needs of the third world.  I am disgusted by your attitude, and the 
recommendation of this TF bears testimony to the inadequacy of this Council's 
leadership in the global arena.

Finally, the most recent amendments to the Review TF Final report confer new 
powers to these abusive, unrepresentative and vile Task Forces at the 
continued expense of working groups and the membership of the General 
Assembly:  

"Such a report is written after: either The Names Council establishes a 
working group as specified in appendix A, the working group invites 
participation, the working group produces reports as specified in Appendix A. 
 Or The Names Council establishes a task force of its members, that task 
force outreaches to impacted groups, the task force produces an interim 
report subject to a public comment period and submits a final modified report 
with content as specified in Appendix A art.14,  to the NC."

This is just another sick attempt by Phil Sheppard to eliminate Working 
Groups from the DNSO.

If anyone on this Task Force has bothered to read to the public comments 
(which are ignored as much as comments from the Non-Commercial constituency) 
you would have noted the following:

Adam Peake:  "The task force system should be abolished and all DNSO policy 
making conducted through the open processes: working groups".

The Internet community is thoroughly disgusted by the task force model used 
by the NC.  If the Council adopts the above language with regard to Task 
Forces, the General Assembly will assuredly withdraw its participation from 
all Council activities.  We will no longer serve to legitimize this farce.
