There is limited case law in this realm.  What there is, such as the 
rejection of the IOD SRO, strongly calls for restraint (that's a pun, for 
those not paying close attention) in casting legal assertions upon these 
waters.

For that matter, these sorts of touting of legal positions serve only to 
distract from the topics at hand.  Lousy negotiating style unless, of 
course, distraction is the goal.
