A claim of a "permanent right to a delegation" is not the issue at 
all.  The issue is the policy underlying the delegation to begin 
with.  This is completely and transparently obvious -- no new gTLDs 
have been delegated; many ccTLDs have been delegated.  If they were 
under the same delegation policy, then we would have many new gTLDs, 
as well.
