Huh?  Where do you get this from?  It is certainly not the "law."  The PTO does not "own" trademarks.  There is no license granted by the PTO to the trademark holder.  Trademark rights attach upon use and are not dependant upon registration by the PTO or any other agency.

The owner of a mark is the first person to adopt and use it - and the scope of protection afforded a particular trademark is determined by the strength of the mark and the extent and nature its use.
