Christopeher and all,

  Perhaps Name.space is claiming and exorbitant number of TLD's,
perhaps not.  However as point of law they do have the right of first use
to register Domains in those TLD name space's, and there isn't much that
the ICANN can legally do about it unless there is a settlement made out of
court with Name.space. Nor is is likely that a supreme court ruling will
uphold a decision to exclude name.space that right to have those entered into
the Root servers, should Name.space choose to push the issue.

  All this is not to say that they are right or wrong, it is to say that none
of us are really qualified at this juncture to make that decision.

  The best end game scenario for Name.space and the ICANN to make
at such time if ever that the ICANN is in control of the root, that these
parties settle these issues out of court or that the DNS itself evolve in the
next two years to allow for multiple registries and Roots where those
registries are synched constantly.
