At the hearing today the Judge made the following ruling and clarification
to last week's preliminary injunction. First, as a result of the ePrize
plaintiff's failure to post its $800,000 bond, the Smiley plaintiff has
until next Wednesday to post the entire $1.6 million dollar bond. With
regard to the previously reported provision about the $3 million dollars
required to be posted by NeuLevel, the Judge ruled that NeuLevel was
required to reserved the 3 million for accounting purposes, i.e. it did not
have to pay the 3 million dollars to the court. If the full 1.6 million
dollar bond is not posted by next Wednesday, the preliminary injunction will
be dissolved.
