Bryan, Rick and all:

The proposal which Tucows put forward to limit the ability of third parties
to access who-is data was presented to many sectors within the DNSO and to
our knowledge it is still before the names council, and we expect the names
council shortly to announce some form of public process whereby the public
will be asked to comment on privacy issues,including specifically bulk
who-is, which is the name applied to the compulsory sales of our customer
data.

We are also aware that the European Commission has written VeriSign
directly, stating their objections to the provisions of the Registration
Agreement which make disclosure of this data mandatory.

I am informed that the EC will favour a trusted third party approach to the
holding and disclosure of this data.


In process terms, the Names Council who-is committee now claims jurisdiction
on the issue. However, we would like to see some action from ICANN on this
topic, as regards helping the process of public consultation get started. I
am informed that ICANN's cooperation is needed to get the web-based
consultation moving.

It is also open to the registrars to develop a paper on bulk who-is, the
trade-offs with privacy concerns, and to answer the question whether
registrars will want to provide a new service of providing an
address-for-service for domain name holders, as who-is material becomes more
restricted.

I would be interested in hearing from any registrars who would like to
particpate in the drafting of a possible position paper on these issues.


This issue ranks behind getting the new domain name suffixes in operation
but I think that we should not lose sight of this issue, and should press
forward to find common ground and an acceptable policy.

Rick,

I received the same call today.  My guess is that they're phoning
all of us and asking the same question regarding bulk whois data.

As registrars, our accreditation agreement with ICANN requires us
to provide bulk whois data to any organization that asks for it,
although we're allowed to charge up to $10,000 per year and limit
updates to once a week.  In addition, we have certain rights &
obligations, including causing the purchaser to agree not to spam &
allowing our customers to opt-out in some fashion.

There have been some attempts by members of the Registrar Constituency
to limit the implications of this section of our accreditation
agreement.  I may have disagreed with the timing of one of such
attempt (concurrent with protests against the new agreement between
Verisign & ICANN), but I certainly agree with the general goal of
limiting this onerous & unfair burden.

Essentially, it requires us to give our customer lists to anyone
with $10,000.  No other competitive industry I know of has to abide
by such an insane policy.  Furthermore, it's the kind of restriction
placed on monopolies, designed to limit their influence, but it
applies to all registrars, no matter how small.  That makes no sense
whatsoever, since there are very few barriers to entry in becoming a
registrar.

By the way, the company appears to be ComoreTel, which is, I think,
the telecommunications company part-owned by the nation of Comore
trying to push the Global269 international toll-free number.

I got a call today from an unnamed telecom organization today asking if I
would share my registrant/contact data. They stated that other registrars
"share" their infomation.

I started to ask lots of questions and they cut the call short.

Has anyone else been approched by simular calls? I would like to know if
any one knows who the company is and what they do with the information.
