Artículo XX. [Nombres de dominio en Internet

1. Las Partes participarán en el Comité Asesor de Gobiernos de la Corporación de Asignación de Nombres y Números en Internet (ICANN) con el fin de promover la administración adecuada de los nombres de dominio de nivel superior (ccTLD) y de las prácticas de delegación, así como las adecuadas relaciones contractuales para la administración de los ccTLD en el Hemisferio.

2. Las Partes se asegurarán de que sus respectivos Centros de Información en Red (CIR) participen en el Procedimiento Uniforme de Solución de Diferencias de la ICANN para abordar el problema de la piratería cibernética de las marcas de fábrica o de comercio.]

Artículo XX. [Nulidad y transferencia de nombre de dominio

Cuando un signo distintivo notoriamente conocido se hubiese inscrito indebidamente en el país de la parte, como segmento de un nombre de dominio o de dirección de correo electrónico de un tercero no autorizado, a pedido del titular o legítimo poseedor de ese signo, la autoridad competente conocerá del asunto y si fuere procedente, ordenará la nulidad o la modificación de la inscripción del nombre de dominio o dirección del correo electrónico de acuerdo a la ley nacional respectiva, siempre que el uso de ese nombre o dirección fuese susceptible de tener alguno de los efectos siguientes:

1. Riesgo de confusión o asociación con el titular o legítimo poseedor del signo, o con sus establecimientos, actividades, productos o servicios;

2. Daño económico o comercial injusto al titular o legítimo poseedor del signo por razón de una dilución de la fuerza distintiva o del valor comercial o publicitario del signo;

3. Aprovechamiento injusto del prestigio del signo, o del renombre de su titular o legítimo poseedor.

La acción de nulidad o modificación prescribirá a los cinco (5) años, contados desde la fecha en que se inscribió el nombre de dominio o de dirección de correo electrónico impugnado, o desde la fecha en que los medios electrónicos, aplicándose el plazo que venza más tarde, salvo que la inscripción se hubiese efectuado de mala fe, en cuyo caso no prescribirá la acción. Esta acción no afectará la que pudiera corresponder por daños y perjuicios conforme al derecho común.]

Article XX. [Domain names on the Internet
1. Parties shall participate in the Government Advisory Committee (GAC) of the Internet Corporation for Assigned Names and Numbers (ICANN) to promote appropriate country code Top Level Domain (ccTLD) administration and delegation practices and appropriate contractual relationships for the administration of the ccTLDs in the Hemisphere.

2. Parties shall have their domestic Network Information Centers (NICs) participate in the ICANN Uniform Dispute Resolution Procedure (UDRP) to address the problem of cyber-piracy of trademarks.]

Article XX. [Cancellation and transfer of domain name

In the event that a well known distinctive sign has been inappropriately registered in the country of the Party, as part of a domain name or electronic mail address of an unauthorized third party, on request by the owner or legitimate rightholder of that sign, the competent authority shall consider the matter and, where appropriate, shall order cancellation or amendment of the registration of such domain name or electronic mail address, in accordance with the respective national law, provided that use thereof would be liable to have one of the following effects:

1. Risk confusion or association with the owner or legitimate rightholder of the sign, or with his or her establishments, activities, products or services;

2. Cause unfair economic or commercial injury to the owner or lawful rightholder of the sign, arising from a dilution of its distinctive force or commercial or publicity value;
3. Make unfair use of the prestige of the sign, or of the good name of its owner or lawful rightholder.

The action of cancellation or amendment shall prescribe, for a period of five (5) years from the date on which the disputed domain name or electronic mail address was registered, or from the date on which electronic media, whichever period expires later, except where the registration was made in bad faith, in which case the action shall not be prescribed. This action shall not affect any other action that might be available with respect to injuries and damages under common law.]

I have been following how some of the ccTLDs that have been incorporating
administrative dispute proceedings into their ccTLD operations. Although
most of the documents and policies are based on ICANN original UDRP, it is
interesting to note some of the enhancements and/or modifications that have
been made. I believe these documents could provide an excellent reference
point for this Task Force to use.

Two sources that I have listed below are the new .UK DRS policy and an
article about the drafting of the .CA dispute policy. It is very interesting
to note the proposed $5,000 penality for false reverse domain name hijacking
claims in the .CA article.
