A public utilities commission is government.  ICANN is private, but 
acting as government.  It is, in fact, acting like a monopoly in the 
rootzone business and attempting to control who can or cannot 
participate in the industry.  It is acting like government in setting 
policy that citizens (users) must comply with, but who have no real 
representation in that government.  So it is more like a dictatorship 
with advisors.  It is something undefined in law that can create 
policies that act and look like law by fiat and that supercedes law.
