1. Participants in this ICANN group are urged
to establish a Breakup Case Working Group with
two simple goals:

(i) to assess and monitor in realtime the prospects
for success of "the ICANN Breakup Case" (Notification
to the Australian Competition and Consumer Commission
re ICANN/auDA breaches of the Trade Practices Act).

(ii) to prepare a 15-20 page briefing document to
the 19-member Boardon the dissolution and winding-up
of "ICANN" -- California, USA corporation with real name
Internet Corporation for Assigned Names and Numbers (=ICANN)
in the event that the TPA breaches are recognised by the ACCC.

2. Participants who have read all postings to this list
are all well aware of the several substantiatable allegations
posted to date of monopolistic practices by ICANN and of
its "inappropriate proximity" (to use a neutral term when
"corrupt links" springs to mind) with powerful officials
of both the USA  (Government Executives and some Elected
Representatives/Legislators) and USA corporations
(Executives and Board-Members).

3. Formal written notice is now hereby given to all those
posting to the list that the proceedings on this list, and
selected particular messages and threads, will be placed
before any court (including an Australian court or tribunal
in February 2001 to demonstrate the arguability of the
TPA breaches for the purposes of "injunctive relief"--
a stop-order to proposed ICANN Melbourne Meeting 10-13 March 2001).

4. It is in your own interests to establish the Breakup Case
Working Group forthwith (yes, even prior to the election of
this ICANN group's co-chairperson). You should be seen to
be taking very seriously the prospect of a Breakup Order
and the other options for competitive root services and
new tlds already in place and functioning (albeit under
duress from ICANN and auDA) on the internet/evernet.

5. Considering that most of this small group are not only
unpaid but are also giving up holiday/family time they can
never get back, it is notable that for many of the ICANN
officials and "ruling powers" it is part of their wellpaid
job to participate in ICANN meetings, discussions, etc.

6. However, it is also notable that all those in this group
also enjoy connectivity and "names" (internet addresses and
identifiers)-- a situation of privilege and trust creating a
fiduciary obligation to most of the rest of the world who
have never even made a phone call. We have no right to
extinguish their future choices for names and connectivity.
