I'm going to regret posting this, but just for the sake of argument, if
someone is not authorized to sell a "root a server" domain name today (as
opposed to selling an alternate root server registration today), then why
is it a mistake to question whether a contract to sell such a domain name
today is perhaps unenforceable (unless the proto-registrar was silly enough
not to put in a clause referring to the ultimate registration being
dependent on the actions of others (as in ICANN)?

ICANN wouldn't be cancelling an exisitng contract, it would be refusing to
recognize obligations to which it was not a party.
