I found it.

Cubby v. CompuServe, 776 F.Supp. 135 (S.D.N.Y. 1991).  Electronic
newsletter publisher Cubby sued the Compuserve system for carrying a
rival, supposedly libelous, newsletter.  The court dismissed the claims
against Compuserve because its role was restricted to transmitting
someone else's offending newsletter.  (The first federal case recognizing
that online systems deserve strong First Amendment protection.)
