Wrong again, Kent.  The process was NOT decided by anyone having the authority
to make those decisions.  NSF NEVER delegated that authority to IANA, and IANA
has no right to decide that.  gTLD-MoU's claims are no more valid that 

It is clear to ANYONE outside the process in reading the Judge's statements
that he was operating on patently false assumptions, and was indeed in awe of
the internet as a whole, and the "Godfather" complex of some of the people who
testified who had a real interest in seeing the CORE plan go forward.

But the case was all moot, since IANA has NO operational authority to give the
nod to ANY new gTLD registries.   They were delegated policy functions for the
delegation of ccTLDs, NOT gTLDs.

Not true again.  gTLD-MoU, CORE, PAD, whoever you care to characterize it as
today, has NO more valid a claim than IOD or Iperdome.
