Actually, Bret, that is the real problem, and somewhat off-topic for this
group. But, yes, there will be instances where a domain is getting ready to
drop, and a trademark owner finds that someone else has the WLS subscription.
I had proposed a WLSDRP, under which a trademark owner could challenge a WLS
subscription holder if they could prove that the WLS subscription holder had
no legitimate rights in the WLS slot, and had taken out the WLS slot in bad
faith. The same people who are surprised to find that others have
registered their coveted domain name first, or that others are skilled at
being first in line to register domain names, are going to be freakin'
astounded when they learn the same others are equally skilled at being first
in line to take out WLS subscriptions.
