Neither Dr Postel or the IANA had the authority to grant or delegate
TLDs except those specifically delegated to it for that purpose (i.e.
ccTLDs).

Do you dispute that?

The facts are that IANA wrote a letter to NSI in the summer of 1997,
and asked them to add new gTLDs.  NSI asked NSF for direction, and NSF
clearly stated "Don't add new gTLDs."

As a matter of fact, revealed in the PGMedia case, in a letter dated
April 4, 1997, the IANA disavowed any authority to make a decision in
response to the requests for new gTLDs.

In the Oct 2 1997 letter that directed NSI to not add new gTLDs
requested by IANA NSF stated, "Network Solutions, Inc.-as
administrator of the root zone-is not authorized to take direction
from any entity other than the National Science Foundation with regard
to the functions that Network Solutions, Inc. performs under the
cooperative agreement."
