If the arbitration centers were to take a slice of the penalty then it might
work - but if not then it only acts as a disincentive for complainants to
file a UDRP claim - and that means less revenue for the arbitration centers
and their panellists (especially those "career" panellists that are little
more than "domain transfer" rubber stamps).

Exactly. There should be a monetary penalty for reverse hijacking
decisions, in compensation to the domain owner.  A punitive like
penalty, that they must agree to pay if they are found to be engaging
in a reverse hijacking attempt as a condition of being permitted to
initiate a UDRP action.

What do the rest of you think of this concept?
