Just some good reading when debating the method and appropriateness of
new constituencies.  There most certainly does not require any amendment
to by-laws to create constitiuencies.
OTOH I cannot imagine that the existing board would want to give domain
name holders more of a voice.
Also note they did it again, they state that it can be done but then say
"pursuant to criteria to be determined" which of course it has not been
determined and therefor cannot be done.

The Board shall recognize a Constituency (including the initial
Constituencies described in (b) below) by a majority vote, whereby the
Constituency shall be deemed to exist for purposes of these Bylaws.


    (a) The GA shall be an open forum for participation in the work of
the DNSO, and open to all who are willing to contribute effort to the
    work of the DNSO. The participants in the GA should be individuals
who have a knowledge of and an interest in issues pertaining to the
    areas for which the DNSO has primary responsibility, and who are
willing to contribute time, effort and expertise to the work of the
    DNSO, including work item proposal and development, discussion of
work items, draft document preparation, and participation in
    research and drafting committees and working groups.

    (d) Participants in the GA shall nominate, pursuant to procedures
adopted by the NC and approved by the Board, persons to serve on
    the Board in those seats reserved for the DNSO.

     Self-organized groups other than the initial groups set forth above
may be recognized by the ICANN Board as DNSO constituency groups upon a
proper showing pursuant to criteria to be determined. The ICANN Board
should periodically review the status of the constituency groups to
determine whether all DNSO interests are adequately represented.


Selection of ICANN Directors
     The DNSO Names Council should seek nominations from the General
Assembly for individuals to serve on the ICANN Board. The Names Council
shall vote from among those nominees to select directors to be submitted
to the ICANN Board of Directors for election under Article IV, Section
