[council] Independent Review Nominating Committee



To the Names Council:

This email is to add another item to the NC's to-do list (don't hurt me!)

In Cairo the ICANN Board approved an Independent Review Policy
<http://www.icann.org/indreview/policy.htm> that calls upon the Supporting
Organization councils to select 2 individuals each for the Independent
Review Nominating Committee.  This email will serve as your formal
notification that there are 2 vacancies on the Independent Review Nominating
Committee to be filled by the Names Council.

The purpose of the Independent Review Nominating Committee is to nominate
the 9 individuals that will comprise ICANN's Independent Review Panel (IRP).
The IRP will have the ability to declare whether an action of the ICANN
Board is consistent with its Bylaws and Articles of Incorporation.  By
turning to the SO councils to choose the Nominating Committee, the policy
seeks to insulate the IRP from the appearance or reality of Board influence.
The Nominating Committee will be a standing body, but will be convened only
when there is an IRP vacancy to be filled.

Section 5 of the policy (copied below) gives the following guidance:

     A.  The NC should select individuals "who are likely to be able to
find, evaluate, and recruit IRP nominees who meet the criteria set forth in
this Policy."  There are three criteria stated in the policy:

"5.12.1 A nominee to the IRP should be a person of high professional
standing and accomplishment."
"5.12.2 A nominee to the IRP should be (i) a current or former judge, and/or
(ii) an individual with legal training who would qualify for judicial
appointment and who has experience conducting arbitration or a similar
dispute resolution proceeding."
"5.12.3 A nominee to the IRP must hold no other office or position within
the ICANN structure."

In other words, the NC should choose 2 individuals who are likely to be able
to find accomplished judges (or their equivalent) to volunteer to serve on
the IRP.

     B.  The NC must choose Nominating Committee members who hold no
official position within the ICANN structure.  "For purposes of this Policy,
the group of individuals ineligible to serve on the IRP Nominating Committee
includes: ICANN Directors; ICANN staff and advisors; members of Advisory
Committees (including the RSSAC and GAC); members of the Supporting
Organization councils; the chair of the DNSO General Assembly; members of
DNSO constituencies councils and administrative committees; and elected
officers of the DNSO constituencies."  [Section 5.3.1]

     C.  The NC should choose one Nominating Committee member for a 3-year
term;  and one for a 2-year term.

5. IRP Nominating Committee

5.1 The IRP Nominating Committee consists of two individuals appointed by
each of the ICANN Supporting Organization councils, as defined in the ICANN
Bylaws.

5.2 The Supporting Organization councils should select as members of the IRP
Nominating Committee individuals who are likely to be able to find,
evaluate, and recruit IRP nominees who meet the criteria set forth in this
Policy.

5.3. Individuals holding an official position or office within the ICANN
structure are not eligible to serve on the IRP Nominating Committee.

5.3.1 For purposes of this Policy, the group of individuals ineligible to
serve on the IRP Nominating Committee includes: ICANN Directors; ICANN staff
and advisors; members of Advisory Committees (including the RSSAC and GAC);
members of the Supporting Organization councils; the chair of the DNSO
General Assembly; members of DNSO constituencies councils and administrative
committees; and elected officers of the DNSO constituencies.

5.4 The members of the IRP Nominating Committee will be appointed for
three-year terms, except that half of the members initially appointed will
be appointed for two-year terms.

5.4.1 In the initial round of appointments, each Supporting Organization
council will appoint one IRP Nominating Committee member to a three-year
term, and one member to a two-year term.
